Decision Summary

  • Case Ref: FS50178268
  • Date: 28/07/2009
  • Public Authority: Ministry of Justice
  • Summary: The complainant requested a list of companies having contracts with 8 named prisons for inmates to carry out paid work for them. He also wanted to know the nature of the work and the value of each contract. The public authority released information in respect of the majority of contractors but withheld the remainder citing section 43(2) of the Act. As some concerns also related to health and safety issues the Commissioner has also considered the application of section 38, although this was not cited by the public authority. The Commissioners decision is that the exemptions at section 43(2) and 38(1) are not engaged. The complaint is therefore upheld and the Commissioner requires the information to be disclosed. The Commissioner further finds that the public authority breached sections 1(1)(b), 10(3) and 17(3).
