The Council refused the request under sections 12 and 14 of the Act. The Commissioner found that the Council had acted correctly in refusing the request under section 12 as the appropriate cost limit would have been exceeded. The Council was not correct to apply section 14 to the request. The Commissioner also found that the Council had breached sections 17(5) and 17(7) of the Act.
