The Council official involved along with the Chartered Surveyor informed the complainant that no such report had been prepared by the public authority and that the police report was not held by the Council. The Commissioner has investigated these matters and has decided on the balance of probabilities the requested information is not held by the Council. He therefore does not require the public authority to take any remedial steps in this case. This decision notice is currently under appeal to the Information Tribunal.
