  • Summary: The complainant requested electronic data relating to tree ring research (dendrochronology). The public authority confirmed that it held the requested information but refused to provide it citing section 12 of the Act. The Commissioner indicated to the public authority that the withheld information fell within the definition of environmental information under the EIR. The public authority subsequently cited the exceptions at regulations 12(4)(d), 12(4)(b), 12(5)(c) and 12(5)(e) to refuse the information. The Commissioner finds that none of the exceptions is engaged and the withheld information should therefore be disclosed. The Commissioner also recorded a number of procedural breaches in the public authority’s handling of the request.
