  • Summary: The complainant made an information request to the Ministry of Justice regarding the implementation of the Freedom of Information Act 2000 and the conduct of civil servants. The public authority deemed the request vexatious and relying on section 14 of the Act refused to meet the request. In investigating the MoJ’s handling of the request, the Commissioner also considered the request in the context and background in which it was made. He finds that the public authority’s refusal to comply with the request by virtue of section 14 of the Act was correct. However, the Commissioner has concluded that the public authority breached section 17(5) of the Act by failing to provide the complainant with the refusal notice within 20 working days of his request.
