  • Summary: The complainant asked for details of contact between the public authority and The Prince of Wales and His Royal Highness’ representatives. The public authority refused to disclose the information requested by the complainant citing sections 37(1)(a), 40(2) and 41(1) of the Act. The Commissioner has considered this case and has concluded that the complainant clearly requested copies of correspondence between the public authority and The Prince of Wales and his representatives – a point which was in dispute. However, the Commissioner has concluded that this information is exempt from disclosure on the basis of section 41(1). Where such information constitutes environmental information as defined by the Environmental Information Regulations, the Commissioner is satisfied that such information is exempt from disclosure on the basis of the exceptions contained at regulation 12(5)(f) or 13(2). The Commissioner has also decided that a list of approaches made by The Prince of Wales and His Royal Highness’ representatives to the public authority, along with the number of any approaches, is exempt from disclosure on the basis of section 41(1).
