  • Summary: The complainant requested details about Derry City Airport's agreement with Ryanair for the use of its airport, as well as how much Ryanair pay to Derry City Council for the use of its airport facilities. The Council refused to disclose the information requested, citing the following exemptions:- section 29(1)(a)(the economy), section 41, (information in confidence) and section 43(2) (Commercial interests). The Commissioner is not satisfied that the Council have demonstrated that prejudice in relation to the exemptions in section 29(1)(a) and section 43(2) would occur, and therefore the Commissioner has not considered the public interest test arguments put forward by the Council in relation to both of these exemptions. In regard to section 41 the Commissioner is satisfied that the exemption in this case is not engaged. Accordingly the Commissioner requires the Council to provide the information requested to the complainant. The Information Tribunal has ruled on this decision and has dismissed this appeal.
