- Summary: The complainant made a number of information requests to Sir William Borlase’s Grammar School (“the school”) between 30 June 2005 and 27 January 2006 concerning information relevant to a complaint made by the complainant on 17 December 1996. The school responded to the complainant by informing her that it would not enter into further correspondence in relation to this matter, as it had been dealt with on a number of occasions by the school and by the Local Education Authority. Subsequent to intervention by the Commissioner the school stated that it had applied section 14(1) of the Act to the complainant’s requests. The Commissioner has upheld the school’s application of section 14(1) on the basis that the complainant’s requests are indicative of a pattern of obsessive behaviour which has imposed a significant burden on the school. The Commissioner finds that the school breached section 17(5) of the Act by its failure to inform the complainant of its application of section 14(1) within the time for complying with the requests.
