Community Health Council

FOIA Schedule I includes:

41 - A Community Health Council established under section 182 of the National Health Service (Wales) Act 2006

SI 2010/289 established:

• Aneurin Bevan Community Health Council
• Abertawe Bro Morgannwg Community Health Council
• Betsi Cadwaladr Community Health Council
• Cardiff and Vale of Glamorgan Community Health Council
• Cwm Taf Community Health Council
• Hywel Dda Community Health Council

That Order also continued in existence:

• Brecknock and Radnor Community Health Council
• Montgomeryshire Community Health Council

These appear to have been established under section 20 of the National Health Service Act 1977, and then continued in being by section 20A when it was inserted by the Health (Wales) Act 2003 and again by section 182 of the National Health Service (Wales) Act 2006. While CHCs established under section 20A are to be treated as having been established under section 182 (National Health Service (Consequential Provisions) Act 2006), it's not clear that the same is true of CHCs established under section 20, and hence it's possible that these last two CHCs aren't public authorities for the purposes of FOIA.
