  • Summary: On the 22 April 2005 the complainant requested information relating to an incident which occurred in the Council building and had been highlighted in the local press. The Council refused the information under section 40 of the Act. (Personal Information). After reviewing and investigating the information the Commissioner is satisfied that for part of the information requested, the Council did not comply with its obligations under section 1 (1) (b) of the Act. For the remainder of the information falling within the scope of the request the Commissioner is satisfied that it is exempt under section 40 (2) (3) (a) (b) of the Act.
