The Commissioner has decided that sections 41 and 42 are engaged in this case and that the public interest in maintaining the exemptions outweighs the public interest in disclosure. The Commissioner finds that the Council failed to comply with section 17 of the Act as it did not inform the complainant of his right to seek a review of the Council�s decision or to refer the matter to the Information Commissioner. However, in other respects, the Commissioner finds that the Council dealt with the request in accordance with Part 1 of the Act and does not require the Council to take any further action.
